Lesson Learned: Judicial Reform: empowering magistrate-civil society collaboration for Guinea’s new democratic future

Reform of the judiciary was one of the key priorities announced by the President of the Republic of Guinea in 2010. Following the legislative elections of September 2013, which marked a turning point in the process of transitioning the country from the earlier dictatorship, the focus on judicial reform became more relevant. The project’s complex but well-articulated process used to identify the specific scope of action ensured that the project was aligned with government objectives regarding reform.

Project Description
The project aimed to contribute to the judiciary reform process in Guinea through establishing a new social contract on justice linking CSOs, magistrates and auxiliaries of justice. Strategically, the project was based on two outcome components, to support increased capacity for advocacy, monitoring and judicial oversight, and enhanced capacity for dialogue and collaboration between civil society and the judiciary on ways to improve the judicial system in order for it to become more responsive to the needs of civil society. This strategic approach appropriate for the limited scope of the project; its key points of strength were the acknowledgement that training was a first step before the setting up a platform for dialogue and the inclusion of a mini-grant scheme. The project was ambitious but realistic. However, the methodology did not include a mechanism to replicate project experiences beyond the target areas of Conakry and Kankan - the most important judicial districts in Guinea - once the project ended.

Lesson Learned: Towards a better electoral process in Mongolia

Some of the project activities changed as the grantee found that the judiciary was not interested in being trained by an NGO. Instead, they translated the International IDEA’s Handbook on Electoral Justice into Mongolian and distributed it to the appellate court judges at working lunches or through the mail. The handbook was also distributed to other actors, including the electoral commission and political parties. This seemed to be an appropriate alternative as the evaluators found the handbook in use by lawyers with election complaint cases pending in the courts, with some judges, party members and the electoral commission stating that they used it as a reference for international best practices and to find specific examples of how other countries handled their electoral dispute resolution.

Project Description
The project sought to strengthen the electoral system and civic participation in Mongolia by raising the level of voter education and public awareness on democratic institutions and processes. Its main objectives were: to prepare a voter education high school curriculum; establish a network of volunteers able to train on voters rights issues; improve the skills of key officials involved with elections; and implement a public awareness campaign for voters for the elections in 2012. Its intended outcomes were to have its voter education curriculum adopted by the Ministry of Education as part of the national school curriculum; trained observers and officials ready for the 2012 elections; and, a more knowledgeable public on voter issues. It is evident that this project contributed towards these results and to the more positive outcome of the 2012 electoral process when compared to the situation in 2008. The project started early when no one else was working on these issues, and it was a sizeable project for the sector. However, the extent of the project’s reach and its actual impact is unknown.

Lesson Learned: Strengthening the capacities of Magistrates

This initiative was the first of its kind by the grantee in Niger. Although the grantee did not put in place measures to ensure sustainability, it successfully raised awareness among the magistracy of the necessity to communicate with stakeholders external to the judiciary. The project prompted beneficiaries to create the association of investigating judges in Niger (AMPN), whose mission it will be to provide similar, additional training for magistrates.

Project Description
The project organized training for judges and activities to create discussion among magistrates on the adoption of the Ethical and Deontological Code in Niger. The project objectives were: to improve the capacity of investigating judges, prosecuting attorneys and state prosecutors to fight economic and financial crimes related to public finance; to increase the magistracy body’s knowledge of the Ethical and Deontological Code’s principles; and to establish a network of specialised judges to fight economic and financial crimes related to public finance. These thematic areas, such as the fight against economic and financial crimes and the raising of moral standards among the magistracy, were relevant for the country in terms of building judicial transparency. While the training and awareness-raising activities aimed to improve the functioning of justice and at improving ethics, the project’s design was not based on a thorough screening of available information about the main issues faced by judges, and also lacked a clear methodological approach.

Lesson Learned: Training citizens on law and on institutional dialogue in the Democratic Republic of Congo

The grantee’s long-term engagement with the police and the judiciary in the Democratic Republic of Congo contributed to the project’s success, as it helped to overcome resistance to activities such as human rights awareness raising campaigns in police and military camps, and the organization of open days in courts.

Project Description
The project aimed to enhance the legitimacy of the judicial system in order to reinforce democratic processes in the Democratic Republic of Congo. Specifically, the project was designed to improve the legal knowledge and sense of responsibility on the part of civil society actors by raising awareness of human rights among citizens and by improving trust between citizens and judicial institutions, as well as better liaison between judicial actors and civil society. The beneficiaries included the population of two municipalities in suburban Kinshasa, as well as families of military and police personnel housed in camps in the area; police officers, prosecutors and judges; and a group of trained NGO resource persons. The project was based on a sound strategy, which identified explicitly the institutional weaknesses that were to be addressed, and proposed realistic steps to address them. The training sessions for NGO resource persons and the seminars bringing together civil society, police and members of the judiciary were implemented to a particularly high standard, as they were both innovative in their field, and carried out with appropriate levels of skills and monitoring.
